1. About NexSpeak

NexSpeak is a language learning platform that helps Spanish speakers learn real British English through stories, audio, and a structured memory method. By accessing or using NexSpeak, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use our application.

3. Eligibility

You must be at least 13 years old to use NexSpeak. By creating an account, you confirm that you are 13 or older.

If you are under 16 years old and located in the United Kingdom or European Union, you may only use NexSpeak with the consent of a parent or legal guardian, in accordance with UK GDPR Article 8.

We do not knowingly collect personal data from children under 13. If we become aware that a user is under 13, we will delete their account and data promptly.

4. Subscription Terms

NexSpeak offers the following plans:

  • Free tier: Access to all A1 stories at no cost, with no advertising. No credit card required.
  • Premium — Monthly: £6.99 per month. Gives access to all stories (A1 through B2) and all premium features.
  • Premium — Annual: £49.99 per year (equivalent to approximately £4.17 per month). Same access as monthly.

All prices are in British Pounds Sterling (GBP) and include any applicable VAT.

Auto-renewal: Subscriptions renew automatically at the end of each billing period. You will be charged using the payment method on file. You can cancel at any time from your account settings — cancellation takes effect at the end of the current billing period, and you retain access until then.

5. Your Right to Cancel (14-Day Cooling-Off Period)

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your subscription within 14 days of purchase without giving any reason and receive a full refund.

Important exception: If you start using premium content immediately after subscribing, you may be asked to acknowledge that you are requesting early access to digital content and understand that this may affect your right to cancel. This is in accordance with Regulation 37 of the Consumer Contracts Regulations 2013.

6. Refund Policy

Beyond the 14-day cancellation right above, NexSpeak subscriptions are non-refundable once a billing period has been charged, except in cases of technical failure on our part that prevented access to the service.

If you believe you are entitled to a refund, contact us at [email protected]. We will review your request and respond within 5 business days.

7. User Accounts

When you create an account, you must provide accurate information. You are responsible for:

  • Maintaining the security of your account and password.
  • All activities that occur under your account.
  • Notifying us immediately of any unauthorised use of your account.

8. Acceptable Use

You may not use NexSpeak for any unlawful purpose or to violate any laws in your jurisdiction. You may not attempt to scrape, extract, reproduce, or redistribute our story content, audio recordings, or learning structures outside the application. You may not attempt to reverse-engineer, decompile, or disrupt the platform.

9. Intellectual Property

All story content, audio recordings, flashcard structures, translations, and learning materials provided in NexSpeak are the property of Javier Wilfrido Garcia Goyes (trading as NexSpeak) or its content providers, and are protected by copyright law.

NexSpeak™ is a trade mark of Javier Wilfrido Garcia Goyes (UK Trade Mark Application No. UK00004369436, Classes 9 and 41). You may not use the NexSpeak name or logo without prior written permission.

10. Limitation of Liability

To the maximum extent permitted by law, NexSpeak and its operator shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law.

These Terms do not affect your statutory rights as a consumer under the Consumer Rights Act 2015.

11. Termination

By you:You may cancel your subscription at any time from your account settings. You may delete your account and all associated data via the “Delete Account” option in your profile.

By us: We reserve the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, or otherwise misuse the platform.

12. Governing Law & Disputes

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

For consumer disputes, you may also use alternative dispute resolution (ADR) schemes. Further information is available from the Citizens Advice Bureau: citizensadvice.org.uk.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by email or via a notice within the app. Continued use of NexSpeak after changes become effective constitutes acceptance of the updated Terms.
